Terms of Service

1. Acceptance of Terms
By accessing or using Hotelary.ai ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Geeks and Beasts Consulting Pvt Ltd ("Company", "we", "us").
If you are using the Platform on behalf of a hotel or organization, you represent that you have the authority to bind that organization to these Terms.
2. Service Description
Hotelary.ai is an AI-powered hotel management operating system that provides:
- Property management system (PMS) with booking engine
- WhatsApp AI automation for guest communication
- Point of sale (POS) for restaurant and services
- Inventory and stock management
- Guest CRM and campaign management
- Analytics, reporting, and business intelligence
- Housekeeping and workflow automation
- Staff management and payroll
- Channel manager integration
- Finance and accounting with GST compliance
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice.
3. Account Registration
To use Hotelary.ai, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain one account per hotel property (multiple properties require separate accounts)
- Keep your login credentials secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
4. Pricing & Billing
- Subscription Pricing: Hotelary.ai uses a base platform fee plus pay-as-you-go model. Your base fee depends on hotel size (Starter, Growth, or Enterprise). Usage-based charges apply for WhatsApp messages, AI conversations, OCR scans, and SMS.
- Payment Processing: When using Hotelary's integrated payment gateway, a 3% convenience fee applies to transactions processed. Hotels may opt to use their own payment gateway at no Hotelary processing fee.
- Billing: Payments are processed via Stripe or Razorpay. Invoices are generated monthly and due within 7 days.
- Price Changes: We may adjust pricing with at least 30 days written notice. Existing subscriptions will honor current pricing until the end of the billing period.
5. Account Activation
Upon signing up, you will select a subscription plan based on your hotel size. Your account is activated immediately after plan selection. Usage-based charges begin accruing from the date of activation. You may cancel your subscription at any time as described in section 4.
6. Cancellation
- Monthly Plans: You may cancel your subscription at any time. You will retain access to the Platform until the end of your current billing period.
- Annual Plans: Annual subscriptions are non-refundable. You will retain access to the Platform until the end of your annual term.
- Data Export: Upon cancellation, you may request an export of all your data before your account is deactivated. Data is retained for 90 days after account closure.
7. Data Ownership
You own all data you input into the Platform, including but not limited to:
- Guest information and booking data
- Financial records and transaction history
- Operational data (inventory, housekeeping, staff)
- Communications and guest interactions
We will never sell your data to third parties or share it with competitors. Your guest relationships belong to you. See our Privacy Policy for full details on data handling.
8. Acceptable Use
You agree not to:
- Use the Platform for any illegal activity or in violation of applicable laws
- Abuse, overload, or interfere with the Platform's API or infrastructure
- Reverse engineer, decompile, or disassemble any part of the Platform
- Use automated scraping tools, bots, or crawlers on the Platform
- Share your account credentials with unauthorized third parties
- Upload malicious code, viruses, or harmful content
- Impersonate another person or entity when using the Platform
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.
9. Intellectual Property
The Hotelary.ai platform, including its software, design, branding, documentation, and all related intellectual property, is owned by Geeks and Beasts Consulting Pvt Ltd. You are granted a limited, non-exclusive, non-transferable license to use the Platform for the duration of your subscription.
You retain full ownership of all data, content, and materials you upload or create within the Platform.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Hotelary.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- Our total cumulative liability for any claims arising from or related to these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
- We do not guarantee uninterrupted or error-free service, though we strive for 99.9% uptime.
11. Indemnification
You agree to indemnify, defend, and hold harmless Geeks and Beasts Consulting Pvt Ltd, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
13. Dispute Resolution
In the event of any dispute, the parties agree to the following resolution process:
- Good Faith Negotiation: The parties shall first attempt to resolve the dispute through direct good faith negotiation for a period of 30 days.
- Mediation: If negotiation fails, the parties shall submit the dispute to mediation administered by a mutually agreed mediator.
- Arbitration: If mediation fails, the dispute shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 of India. The seat of arbitration shall be New Delhi, and proceedings shall be conducted in English.
14. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will provide at least 30 days notice via email or an in-app notification. Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform and cancel your account.
